Pursuant to paragraph 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt DSS Marine Inc., 152 Rocky Lake Drive, Bedford, Nova Scotia from the requirements of paragraph 537.205(c) of the Airworthiness Manual made pursuant to paragraph 537.01 of the Canadian Aviation Regulations (CARs) only with respect to the requirements of paragraph 8.1.3.2 of the Canadian General Standards Board Standard CAN/CGSB-65.17-99 on Helicopter Passenger Transportation Suit Systems (hereinafter referred to as HPTSS Standard).
Paragraph 8.1.3.2 of the HPTSS Standard establishes the minimum donning time for Helicopter Passenger Transportation Suit Systems (hereinafter referred to as HPTSS)
The details of the above provisions are provided in Appendix A to this exemption.
Purpose
The purpose of this exemption is to allow DSS Marine Inc. to obtain an Appliance Type Certificate for the HPTSS DSS Marine Incorporated Model DS-HPTS-V01 without complying with the donning time test as required by the HPTSS Standard. The two-minute donning time test is not required as the HPTSS is donned by all persons prior to aircraft departure pursuant to section 602.63 of the CARs, and as such, this activity does not need to occur within a pre-determined time frame.
Application
This exemption applies to DSS Marine Inc. to obtain an Appliance Type Certificate for the HPTSS DSS Marine Incorporated Model DS-HPTS-V01 without complying with the donning time test as required by the HPTSS Standard.
Conditions
This exemption is subject to the following condition:
- This exemption shall form part of the Appliance Type Certificate for the HPTSS DSS Marine Incorporated Model DS-HPTS-V01.
Validity
This exemption is in effect until:
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that the exemption is no longer in the public interest, or that it is likely to affect aviation safety.

Donning Time - Each subject is removed from the view of the other subjects and allowed time to examine the suit system and the manufacturer's instructions for donning and using the suit system. At the end of this period, the subject shall attempt to don the suit system as rapidly as possible without the aid of a chair or any support to lean on; however, the subject may sit on the floor. If the subject does not don the suit system completely, including gloves or mittens and any other accessories as necessary to achieve the thermal protection (par. 6.2.5), within 2 min, the subject removes the suit system, examines the instructions for 1 min and again attempts to don the suit system. At least ten of the eleven subjects shall be able to don the suit system completely within 2 min in at least one of the two attempts. Inflation of the buoyancy element is not required.

Where a helicopter is required to carry life rafts pursuant to subsection (4) or (5), no person shall operate the helicopter over water having a temperature of less than 10oC unless
- a helicopter passenger transportation suit system is provided for the use of each person on board; and
- the pilot-in-command directs each person on board to wear the helicopter passenger transportation suit system.

Every person who has been directed to wear a helicopter passenger transportation suit system pursuant to paragraph (7)(b) shall wear that suit system.
